Terms of Service

The Store is operated by Mazowiecka Grupa Kapitałowa Sp. z o.o., ul. Krokusowa 13, 05-500 Wólka Kozodawska, NIP 1231536793 ("Seller"). Contact: info@smartsailsaver.com, Mon–Fri 8:00–14:00.

1. Scope and Definitions

The Store offers accessories and equipment for campers/vanlife. Part of the assortment is available immediately; part may be made to order or customised. Purchase is possible without registration. User accounts can be deleted on request by e-mail.

2. Prices and Taxes

Prices are shown in PLN or EUR and include VAT according to the buyer's country (OSS rules). Prices may vary dynamically, including promotional pricing and B2B individual terms. Discount codes cannot be combined unless explicitly stated.

3. Orders and Contract Formation

Placing an order is not equivalent to concluding a contract. A sales contract is concluded when the Seller sends an e-mail confirming that the order has been accepted for processing or dispatched. Pre-orders/back-orders are allowed when explicitly marked with estimated delivery times.

4. Cancellation by the Seller

The Seller may cancel an order before dispatch in the case of: a) clear pricing errors, b) incorrect stock levels, c) failed anti-fraud verification or suspicion of abuse. Payments are refunded promptly via the same method.

5. Payments

Online payments are handled through Paynow (Millennium Bank), including card payments and supported digital wallets. No cash-on-delivery. Traditional bank transfer is not available at launch. Orders are processed after successful Paynow payment authorisation. E-invoices are issued by default; paper invoices are available on request.

6. Shipping and Delivery

Available carriers: InPost Lockers/Courier, Orlen Paczka, Poczta Polska, DHL, DPD, GLS; oversized goods/pallets via dedicated freight on request. No same-day dispatch; orders are shipped on the next business day. Delivery times: Poland 1–3 business days; EU 3–7 business days. Outside the EU: shipping on request; duties/taxes are borne by the buyer (DDU). Costs may be recalculated before dispatch based on actual dimensions; dispatch occurs only after buyer approval.

7. Splitting Shipments

Orders are shipped in a single parcel by default. On request the order can be split; each parcel is priced separately.

8. Failed Delivery

If delivery fails due to buyer's fault, the Seller deducts the actual cost of return and re-shipping from any refund. If the buyer cancels after failed delivery, the refunded amount is reduced by those costs.

9. Product Restrictions and Limitations

Products are shipped internationally unless restricted by carrier limitations. Electronics and electrical components that were installed or used may be returned only at the Seller's discretion (goodwill); statutory rights of consumers remain unaffected.

10. Right of Withdrawal

Consumers may withdraw from the contract within 14 days. Exceptions follow statutory law (e.g., customised goods, sealed hygienic goods after opening, goods inseparably mixed with other items).

11. Returns and Exchanges

Returns must be announced by e-mail or via the online form. If the Seller generates a return label, its cost is deducted from the refund. Exchange is processed as a new order after return of the item.

12. Liability and Product Conformity

Claims regarding non-conformity should be submitted to info@smartsailsaver.com with order number, description, and photos/video. The Seller responds within 14 calendar days. Preferred remedy is replacement; if impossible, repair or refund. The Seller covers return and re-shipping costs for accepted claims.

13. Transport Damage

A damage report with the courier is helpful but not required. Damage or DOA should be reported within 24–48 hours with photos. Missing parcels must be reported immediately.

14. Intellectual Property

All texts, photos, and materials are protected. Private use is allowed; commercial reuse requires written permission. Media/partners may use materials only with prior consent and attribution.

15. User Conduct

Scraping, spam, and interference with the Store's operation are prohibited.

16. Reviews (Omnibus Compliance)

The Store verifies which reviews come from actual purchases (order-linked invitations). Reviews are marked as "verified" or "unverified". Illegal, offensive, or infringing content may be removed.

17. Force Majeure

The Seller is not liable for delays caused by force majeure or planned maintenance. Consumer rights remain unaffected.

18. Governing Law and Dispute Resolution

Polish law applies. Consumer disputes are resolved according to mandatory jurisdiction rules. The EU ODR platform is available at https://ec.europa.eu/odr.

19. Amendments

Changes to these Terms are published with an effective date. For account-related services, users are notified 14 days in advance. For orders, the version valid on the purchase date applies.
